Acceptance of the General Terms and Conditions of Sale

These terms apply to the sale of products by Les Halles de Quercamps through its store accessible via the internet, by telephone, by email, and by fax. They are automatically made available to the buyer on the homepage of the website www.hallesdequercamps.com. Consequently, placing an order implies the buyer's full and unconditional acceptance of these "General Terms and Conditions of Sale" (hereinafter referred to as GTC), to the exclusion of any other documents such as brochures, press, catalogs, or emailings issued by the seller, which are for informational purposes only. The fact that the seller does not take advantage of any of the provisions of these terms at a given time cannot be interpreted as a waiver to subsequently enforce any of these conditions. Our offers are exclusively reserved for private customers of legal age and capacity. Article 2: Prices

Our sales prices are those indicated on the electronic catalog of the site at the time of the order. The electronic catalog is regularly updated. Prices are inclusive of VAT, in euros, excluding shipping costs, unless there is a manifest error.

Prices are stated excluding VAT for professionals identifying themselves on the part reserved for professionals.

A detailed table of shipping rates is presented in the "Delivery" section of the site.

Price discrepancies between the Halles de Quercamps store and the site hallesdequercamps.com may occur, the reason being the existence of two very distinct competitive realities.

Article 3: Content of the Order

The order must strictly conform to the offer as issued on the site, particularly regarding formats, quantities offered, and validity dates.

Article 4: Order Steps

The order assumes prior knowledge by the Client of these GTC, the price, and the essential characteristics of the Products chosen, available on the site.

The order is taken through the dematerialized order form accessible online on the site hallesdequercamps.com.

The Client communicates the requested information, necessary for the realization of the sale, in the "Client Space" section. Care is taken on this occasion not to omit any information essential for the proper execution of the delivery, such as a possible access code to the building.

The Client is identified by their email address and personal password.

The Client accepts the order by clicking on "validate" after choosing the payment methods and having entered the required information to enable this, in the areas provided for this purpose. Their acceptance is then final, subject only to the possible exercise of their right of withdrawal described below.

Les Halles de Quercamps confirm the order to the Client by email summarizing it, as well as the terms of exercise of the right of withdrawal, the address of the establishment where the Client can present their complaints, and information relating to after-sales service and commercial guarantees.

Article 5: Loyalty and Referral Program

HDQoins®

Les Halles de Quercamps offer their Clients financial advantages materialized in the form of HDQoins®. The amount of HDQoins is indicated on each eligible article on the site hallesdequercamps.com.

HDQoins are usable after the expiration of a twenty-four (24) hour period from the billing of the order granting rights to the Client, only on our website www.hallesdequercamps.com. HDQoins are not usable in our store. HDQoins can be used to pay for shipping costs.

HDQoins are nominative and valid for 2 years from their date of acquisition.

Products ordered and paid for in whole or in part using Loyalty Euros are not eligible for reimbursement.

The balance of HDQoins acquired via the hallesdequercamps.com website (loyalty and referral) is consultable on the site in the "client space" section.

Article 6: Date of Payment

Any order for a deliverable Product can only be validated if it is accompanied by the payment of the entire price incl. VAT and shipping costs.

In the absence of receipt of payment by Les Halles de Quercamps no later than ten (10) days after the order, it is automatically canceled.

By paying via PayPal, the customer agrees to bear the 2% commission on the total amount of the order, corresponding to the fees charged by PayPal.

Payment Delays

Any sum not paid at the due date automatically results in the application of interest for late payment corresponding to three times the current legal interest rate. In the event of recovery through litigation, a flat-rate indemnity of 15% of the amount of the order will be demanded without prejudice to interest for late payment and damages and interests.

Article 8: Retention of Title

The transfer of ownership of the Products to the Client is delayed until full payment of the order price, Les Halles de Quercamps reserving the right to repossess the Products in case of non-full payment of the price.

Article 9: Availability of Products

Offers are always formulated subject to available quantities.

In case of unavailability of the ordered Products and subsequent cancellation of the order, the price will be refunded to the Client within one (1) week.

Article 10: Destruction, Loss, or Theft

In case of destruction, loss, or theft of the Products before the scheduled delivery date of the order, in the absence of available stock to proceed with its replacement, the Client will be refunded the sums paid by them, excluding any other indemnity, within thirty (30) days of the date of the disaster.

Article 11: Delivery

The order specifies the place of delivery or, where applicable, the Client's intention to collect the Products themselves from the store. The Client must receive or collect the merchandise within a maximum of thirty (30) days following receipt of their order.

Any change in the place of delivery must be indicated by the Client to Les Halles de Quercamps no later than 48 hours before the desired delivery date and in any case before the order is taken over by the carrier.

The indicative standard delivery time is 3 to 15 working days following the day of processing the validated order and the mode of transport chosen by the Client. Guaranteed delivery times do not apply to the sale of en primeur wines.

If the Client should exceptionally note the absence of delivery within the above-mentioned times, they should immediately notify Les Halles de Quercamps to allow them to remedy the problem as soon as possible, the execution of the order then taking place no later than thirty (30) days from the latter.

If the Client has chosen to collect the merchandise in the store of Les Halles de Quercamps, it will only be delivered to the author of the order. To validate their identity, an ID will be requested.

Delays in delivery cannot give rise to damages, withholdings, or cancellation of orders in progress. However, if one month after a written complaint from the client, the merchandise has still not been delivered, the sale may then be resolved at the initiative of one or the other of the parties. The client will obtain a refund of their payment excluding any other indemnity or damages and interests, no later than within one month. In any event, delivery within the time limits can only occur if the client has communicated accurate recipient details to the seller. In case of error, Les Halles de Quercamps cannot be held responsible for the impossibility of delivering the goods in place and time intended. The goods always travel at the risk of the recipient. Upon receipt of the goods, it is the recipient's responsibility to check the condition of the goods upon receipt and to make all necessary findings in case of breakage, damage, or shortages, by expressing detailed reservations on the delivery slip, and within 48 hours following receipt of the goods, by registered letter with acknowledgment of receipt to the carrier, with a copy to the seller, in order to preserve their rights.

The warranty for hidden defects applies under the terms and conditions set by law. The warranty for hidden defects does not cover any fortuitous event and, in particular, any degradation of the product due to transport conditions and inappropriate storage conditions of the product (temperature, humidity, exposure to light...)

It is the buyer's responsibility, if necessary, to seek the seller's advice to ensure proper storage of the ordered product. The seller provides no warranty in this regard.

Intracommunity Delivery

Any order placed on our website hallesdequercamps.com and delivered in a European Union country is subject to the application of French law and taxes. Therefore, the buyer wishing to be delivered in an EU country mandates the company Les Halles de Quercamps to take care of the removal and transportation of the merchandise for their account with the carrier of their choice. Under the application of French law, any delivery to the EU is quantitatively restricted to 90 liters (equivalent to 120 bottles of 0.75L) for still wines and to 60 liters (equivalent to 80 bottles of 0.75L) for sparkling wines, and in any case to 120 bottles for mixed orders without exceeding the limit of 60 liters of sparkling wines. By accepting our GTC during the placement of their order, the buyer certifies having read these provisions and accepts them in their entirety. In the event that an order exceeds these quantitative limits, Les Halles de Quercamps will refuse the order and will then propose a pricing according to the rights and taxes of the country of export. Article 12: Right of Withdrawal

In accordance with Article L. 121-17 of the Consumer Code, the Client has a period of fourteen (14) calendar days, from the receipt of the Products, to exercise their right of withdrawal, in accordance with Articles L. 121-21 and following of the Consumer Code.

This right of withdrawal can be exercised by mail at the address contact@hallesdequercamps.com or by postal mail at the following address: Les Halles de Quercamps, 15 rue des Fiefs – 62380 Quercamps.

When the Client exercises their right of withdrawal, the Products are returned at their expense and at their own risk, to the above address, no later than within fourteen (14) days following the communication of their decision to withdraw.

The Products returned by the Client will only be accepted by Les Halles de Quercamps if they are in their exact original condition (unopened bottles, undamaged caps and labels) and accompanied by their original packaging.

When the Products have been sold as part of a promotional lot, the entirety of it must be returned to Les Halles de Quercamps, due to the indivisibility of the order and the overall price billed.

By exception, these provisions will not apply to orders for products that are personalized or specifically requested by the client during their order (special formats, personalized packaging, ...).

Les Halles de Quercamps will proceed with the refund of all sums paid, excluding delivery costs, as soon as possible and no later than within fourteen (14) days following the date on which they were informed of the Client's decision to withdraw.

The refund may be deferred until the perfect recovery of the Products or until the Client has sent them proof of the shipment of these Products, the date retained being that of the first of these facts.

In accordance with Article L. 121-21-8 of the Consumer Code, this right of withdrawal does not apply to en primeur sales.

Responsibility in case of website failure or service suspension

Les Halles de Quercamps decline all responsibility resulting from the interruption of access to the website, and/or any technical dysfunctions or failures of any kind, regardless of their duration or frequency. It is reminded that any user can contact the order service by phone and/or go to the company's store.

Article 13: Force Majeure

Les Halles de Quercamps cannot be held responsible for losses, damages, or failure to deliver an order resulting from a force majeure event (such as storms, floods, road accidents, etc.).

Article 14: Applicable Law - Jurisdiction

Any relationship between Les Halles de Quercamps and the Client is governed by French law. The Customer Service of Les Halles de Quercamps is at your disposal to amicably resolve any problem resulting from an order and its execution. In case it is impossible to find an agreement, all conflicts arising from the execution of an order or the interpretation of these GTC, and more generally of conventions of any nature concluded between the parties, will be submitted to the competent courts.
